PHOTO CONTEST COPYRIGHT ASSIGNMENT

hereinafter "Image". This agreement between Photographer and the FSF entails the following:

1. The FSF may use Image at its discretion, in any publication and/or on any website or in any other format. I understand that other persons will be free to copy and/or print and/or distribute Image provided they follow Creative Commons crediting. The FSF may also adapt Image (copyright notice will note that Image has been adapted from its original state as received by the FSF).
2. The FSF has all the rights of a copyright owner in the assigned copyrights, subject to the license grant-back to Photographer states above, including the right to enforce the copyright in aid of the free software purposes of this agreement, the right to use, license and distribute Image, and the right to make adaptions based on Image and use, license and distribute them.
3. I understand that for the use of Image by the FSF, I will not receive financial compensation or payment of any kind from the FSF.
4. Photographer warrants to the FSF that they are the sole copyright holder of Image, conveyed either now or in the future under this agreement.
5. This agreement and all conveyances made pursuant hereto are deemed made in Massachusetts. This agreement and all such conveyances being deemed made under seal, as of the date of fixation of any work hereby in tangible form and, also, as of the date of the execution of this agreement by Photographer.
6. This agreement shall be governed and construed in accordance with the laws of the United States and the Commonwealth of Massachusetts, excluding that State’s choice-of-law principles. All claims relating to or arising out of this contract, or the breach thereof, whether sounding in contract, tort or otherwise, shall likewise be governed by the laws of the United States and the Commonwealth of Massachusetts, excluding that State’s choice-of-law principles.
